PharmacyChecker.com LLC lost an antitrust fight against several industry groups that the drug price verification firm accused of anti-competitive conduct.
The defendants have argued that Westchester County, N.Y.-based PharmacyChecker.com promotes illegal importation of prescription drugs from foreign pharmacies for personal use. Judge Kenneth Karas of the US District Court for the Southern District of New York agreed.
“Defendants have met their burden to prove that PCC’s enterprise is ‘completely or almost completely geared towards facilitating illegality,’” Karas said in his March 28 summary judgment that was under seal until Monday.
