A federal judge dismissed two defendants in an antitrust suit against Supernus Pharmaceuticals over claims it conspired with others to block a generic drug for Parkinson’s disease.
Judge Christopher J. Burke of the US District Court for the District of Delaware said in Tuesday order that plaintiff Sage Chemical didn’t sufficiently allege that two entities, US WorldMeds Partners and USWM LLC, engaged in anticompetitive conduct and therefore they can’t be liable for an antitrust conspiracy over the brandname Apokyn drug, which is used to treat Parkinson’s disease.
