NCAA Says Kansas Basketball Team Brought Antitrust Suit Too Late

The NCAA moved to dismiss a proposed class action brought by Mario Chalmers and other members of the 2008 Kansas Jayhawks national champion men’s basketball team, saying the plaintiffs waited far too long to bring their antitrust claims.

Chalmers’ suit is time-barred by a four-year statute of limitations on antitrust claims because the case’s proposed class definition ends in 2016—eight years ago—the NCAA said in a motion to dismiss filed Oct. 18 in the US District Court for the Southern District of New York.
