McKesson, AmerisourceBergen Win Bid to Toss Price-Fixing Claims

McKesson Corp. and AmerisourceBergen Drug Corp. are among the drug distributors that won a bid to toss antitrust claims that they colluded to inflate prices of several generic pharmaceutical products.

Judge Cynthia M. Rufe of the US District Court for the Eastern District of Pennsylvania in an order granted the companies their joint motion to dismiss with prejudice, saying reseller plaintiffs “failed to sufficiently allege the existence of an explicit agreement” between the distributors and drug manufacturers to allocate the market share of generic pharmaceuticals and bring about supercompetitive prices.
