Marathon Must Defend Kentucky’s Monopolization Suit

Jack Conway, Kentucky’s attorney general, has viable antitrust and consumer protection claims against Marathon Petroleum Co. LP for allegedly using contracts and restrictions to dominate gasoline supply and drive up prices in Northern Kentucky, a federal court said June 8 (Kentucky v. Marathon Petroleum Co., 2016 BL 182993, W.D. Ky., Civil Action No. 3:15-cv-354-DJH, 6/8/16).

Judge David J. Hale held that Conway adequately stated restraint of trade, monopolization and exclusive dealing claims against Marathon based on contracts that allegedly tied retailers to using Marathon to supply gasoline in Northern Kentucky exclusively. The claims will now proceed to ...
