Law School Admission Group Ducks Application Fee-Fixing Suit (1)

A federal judge dismissed for now a fee-fixing suit against the Law School Admission Council, concluding that while the plaintiff had standing his allegations are “unclear and self-contradictory.”

Plaintiff Linvel James Risner has 14 days to file an amended complaint addressing the deficiencies outlined by Judge John F. Murphy of the US District Court for the Eastern District of Pennsylvania in a Tuesday opinion granting LSAC its motion to dismiss the suit without prejudice.

“Mr. Risner has two things going for him: he alleges concerted action, and he has antitrust standing,” Murphy said. “The rest presents an uphill battle.”
