Keurig Plaintiffs Lose Class Status Bid in K-Cup Antitrust Case

A federal judge denied class status to direct purchaser plaintiffs who allege Keurig Green Mountain Inc. used its monopoly power to overcharge them for K-Cup single-serve coffee pods.

Judge Vernon S. Broderick of the US District Court for the Southern District of New York on Thursday denied the plaintiffs’ motion for class certification, saying they didn’t meet key federal standards for predominance and typicality.

“I do not find that Plaintiffs have shown through evidentiary proof that common issues predominate as to antitrust impact for the entire class,” Broderick said.
