Justice Department to Stop Defending Removal Shields at NLRB, FTC

The Department of Justice will stop defending legal protections preventing the president from firing members of independent agencies, including the Federal Trade Commission and the National Labor Relations Board, without cause.

A top official further said the department would push the Supreme Court to overturn a 90-year-old Supreme Court ruling that established such removal protections under the Constitution.

Sarah Harris, the acting solicitor general, revealed the plans in a letter, dated Wednesday, to Sen. Dick Durbin (Ill.), ranking Democrat on the Senate Judiciary Committee.
