Jimmy John’s Still Facing No-Poach Antitrust Suit

Jimmy John’s Franchise LLC is still on the hook for potential antitrust violation claims in a class-action lawsuit after a district court judge July 31 declined to dismiss a suit claiming that the sandwich chain’s franchise agreement unfairly harmed competition by preventing employees from seeking employment at other stores.

The suit against Jimmy John’s comes in the midst of an inquiry by 11 state attorneys general questioning several fast-food restaurant chains’ “no-poach agreements.” State AGs sent letters June 9 to eight fast-food chains including Arby’s, Burger King, and Dunkin’ Donuts, asking the restaurants to turn over documents and other information ...
