Jazz Pharmaceuticals, Hikma Lose Bid to Nix Reverse Payment Claim

Jazz Pharmaceuticals PLC and Hikma Pharmaceuticals PLC failed to convince a judge to toss antitrust claims alleging they conspired to delay the generic versions of a narcolepsy drug.

Judge Richard Seeborg of the US District for the Northern District of California on Monday denied Jazz’s motion to toss reverse payment claims and said a reasonable juror could find that Jazz’s conduct was part of a scheme to delay the generic version of narcolepsy medication Xyrem. Seeborg also concluded that there is a “disputed factual issue” concerning Jazz’s ability to restrict output.
