J&J Unit Faces Revived Antitrust Claims Over Cardiac Catheters

Johnson & Johnson unit Biosense Webster Inc. must again face antitrust claims in a case accusing it of monopolizing the nationwide market for heart-mapping catheters after the Ninth Circuit reversed a lower court’s decision.

The district court erred in granting summary judgment to Biosense and in concluding that plaintiff Innovative Heath “failed to raise a genuine dispute of material fact” about the existence of an unlawful tying arrangement, the US Court of Appeals for the Ninth Circuit said in a Friday opinion from Judges Lucy Koh and Donald Molloy. Judge Eric Miller dissented.
