A group of pathologists in Iowa who formed a startup practice and sued their employer with monopolization claims failed to revive their lawsuit after the Eighth Circuit affirmed a lower court’s dismissal of the case.
Although defendants Iowa Pathology Associates PC and Regional Laboratory Consultants PC are separate legal entities, plaintiff Goldfinch Laboratory PC’s complaint “makes clear that they are not separate economic actors pursuing separate economic interests who conspired to restrain competition,” Judge Morris S. Arnold of the US Court of Appeals for the Eighth Circuit said in a Monday opinion.
