Humana Advances Racketeering Claims Over Mallinckrodt’s Acthar

Health insurer Humana Inc. can move forward with racketeering and state law claims over Mallinckrodt ARD LLC’s decision to raise the price of the multiple sclerosis drug Acthar by a factor of 1,000, but it will have to try again to plead antitrust allegations, a Los Angeles federal judge ruled.

The lawsuit is part of a wave of cases targeting Mallinckrodt unit Questcor Pharmaceuticals and various subsidies of Express Scripts Inc., one of the “big three” U.S. pharmaceutical wholesalers.
