FTC Wins Nod to Move Ahead With Surescripts Monopolization Case

The Federal Trade Commission won approval to move forward with a case alleging information technology firm Surescripts LLC conspired to maintain monopolies over electronic prescribing markets.

The FTC’s claims against Surescripts aren’t moot, Judge John Bates of the US District Court for the District of Columbia said. While Surescripts said it removed loyalty provisions the FTC challenged, Bates said the company hasn’t promised not to reinstate similar terms in the future.

Bates also held that the Arlington, Va.-based company has had monopoly power in the electronic routing and eligibility markets since at least 2010.
