Smart Vent Products Inc. must face allegations of a scheme to dominate the “flood vent” industry through commercial disparagement and meritless litigation, but not claims that it colluded with a subsidiary to corner the market, a Virginia federal judge ruled.
The antitrust lawsuit accuses Smart Vent of telling customers that vents made by rivals aren’t legal, and of suing competitors into submission with sham infringement claims asserting bogus patents.
