Sexual MD Solutions LLC, which markets a shockwave-based erectile dysfunction treatment called GAINSWave, was hit with an antitrust lawsuit in Los Angeles federal court alleging a wide-ranging scheme to corner the market.
The suit accuses the company—whose product was named after its founder, anesthesiologist Dick Gaines—of conspiring with two others to fix prices, refrain from competing with one another, enforce unreasonable license restrictions, boycott rivals, and batter them with sham patent infringement claims.
The collusion has restrained competition, which has increased the therapy’s cost while reducing its quality, the proposed class action claims.
