Equifax Denied Arbitration in Employment Verification Dispute

Equifax Inc. fell short in its bid to compel arbitration in a case alleging the consumer credit reporting giant monopolized the market for electronic verification of income and employment.

Equifax already waived its right to compel arbitration and demonstrated its intent to litigate, meaning the case will proceed in federal court, Judge John F. Murphy of the US District Court for the Eastern District of Pennsylvania said in a Tuesday opinion.

Equifax had argued that plaintiffs Greystone Mortgage Inc. and First Financial Lending LLC agreed to arbitrate by accepting the terms of its revised membership agreement.
