CVS, Walgreens Inch Toward Trial in Amitiza Pay-for-Delay Case

CVS Health Corp. and Walgreens Boots Alliance Inc. will continue to litigate a case accusing Takeda Pharmaceuticals Co. Ltd. of delaying the generic version of the constipation drug Amitiza and causing prices to rise, as a judge largely turned aside a bevy of motions for judgment.

Judge Myong J. Joun of the US District Court for the District of Massachusetts on Wednesday denied Takeda’s motion for summary judgment “to the extent that triable issues of fact exist as to whether Plaintiffs have put forth indirect evidence of an antitrust agreement.”
