CVS Has Standing to Pursue Amitiza Antitrust Claims, Court Says

CVS Health Corp. and Walgreens Boots Alliance Inc. can proceed with antitrust claims that Takeda Pharmaceutical Co. Ltd. delayed the generic version of its anti-constipation drug Amitiza, after a district court judge said the retailers had standing.

Judge Myong J. Joun of the US District Court for the District of Massachusetts in a Wednesday order granted the retailers their motion for partial summary judgment, saying antitrust claims assigned to the retailers from national wholesalers are valid. CVS’s assignment from drug distributor Cardinal Health, for example, confers standing, he said.
