CVS Escapes Defunct Hospital’s Antitrust Suit Over Drug Pricing

CVS Health Corp. convinced a judge to toss antitrust claims brought by a former hospital that alleges the company forced it to purchase services from its Wellpartner subsidiary in order to gain drug price savings through a federal program.

Judge Mia Roberts Perez of the US District Court for the Eastern District of Pennsylvania in a Feb. 26 order and opinion granted CVS’s motion to dismiss, saying she agreed with the company’s assertion that claims by plaintiff Brandywine Hospital were “conclusory” and failed to show anticompetitive effects.
