CVS, Caremark Prevail in Appeal of Pharmacy Benefit Lawsuit

CVS Health Corp. and its Caremark unit defeated claims they conspired to bar a Mississippi pharmacy from their pharmacy benefit management network, as the Fifth Circuit said Wednesday that the pharmacy failed to establish injury and to define relevant markets.

The US Court of Appeals for the Fifth Circuit affirmed a district court’s dismissal of both federal and state antitrust claims brought by Rx Solutions, a retail pharmacy in Mississippi.

The pharmacy claimed that CVS and Caremark colluded to manipulate costs of prescription drugs and forced competitors out of business.
