Cigna Dodges RICO, Antitrust Claims Over Out-of-Network Rates

Cigna Corp.'s behavioral health unit has escaped antitrust, racketeering, fraud, conspiracy, and unfair practices claims in a California federal court over its reimbursement rates for out-of-network “intensive outpatient program” treatments.

Judge Edward J. Davila dismissed the case from the U.S. District Court for the Northern District of California, rejecting allegations that Cigna sought to fix prices by engaging a third-party “repricer,” Viant Inc., to renegotiate over services it had pledged to reimburse at the “usual and customary” rate.
