Chicken Case’s Attorney Fees Must Change, Seventh Circuit Finds

The Seventh Circuit has ordered a lower court to reevaluate $57.4 million awarded attorney fees in a dispute over price-fixing in the market for broiler chickens.

The case centers on an alleged attempt by poultry producers Tyson Foods Inc., Koch Foods Inc., and Pilgrim’s Pride Corp., to exchange competitively sensitive non-public information about prices, capacity, sales volume, and demand in order to fix prices for chicken broilers. Pilgrim’s is a subsidiary of Brazilian meatpacking giant JBS SA. Koch Foods is a privately-held poultry processor that employs more than 13,000 people.
