Cargill Loses Bid to Nix Burford Unit in Turkey Collusion Case

Butterball LLC and Cargill Inc. are among turkey producers that lost a bid to dismiss a unit of litigation funder Burford Capital as a plaintiff in a price-fixing case.

Judge Virginia Kendall of the US District Court for the Northern District of Illinois on Thursday denied the turkey companies’ bid to dismiss Amory, a special purpose vehicle used to hold investments like antitrust claims for Burford Capital, as a plaintiff in the suit.

Kendall ruled that Amory is a “bona fide” plaintiff in the case and not an arms-length third-party that is only financing the litigation.
