Cantor Fitzgerald LP and two affiliate firms escaped claims they unlawfully enforced noncompete provisions in partnership agreements after the Third Circuit affirmed a ruling that dismissed former employees’ antitrust claims.
The US Court of Appeals for the Third Circuit on Monday said the ex-partner plaintiffs failed to link the alleged harm to labor-market competition as well as to the alleged injury—the actual withholding of their compensation as a result of the noncompete restrictions.
