Bay Area Real Estate Information Services Inc. won its bid to dismiss a proposed class action by a seller accusing the multiple listing service of inflating commissions on the sale of their homes.
The complaint didn’t plausibly allege an anti-competitive arrangement stemming from the firm’s rules, Judge Haywood S. Gilliam Jr. of the US District Court for the Northern District of California said in granting a motion to dismiss the case Wednesday with leave to amend.
“These rules simply do not on their face require the results plaintiff alleges they do,” Gilliam said.
