Black Knight Inc. counter-sued the Federal Trade Commission over the constitutionality of the agency’s in-house judge as the mortgage software maker seeks approval of its planned $11.7 billion acquisition by Intercontinental Exchange Inc.
The counterclaim, filed Tuesday in the US District Court for the Northern District of California, comes less than two weeks after the Supreme Court allowed defendants in agency administrative courts to sue over the constitutionality of in-house judges while the proceedings are ongoing.
