A Berkshire Hathaway-owned insulation company faces revived antitrust claims after the Tenth Circuit held that a district court improperly dismissed a monopoly claim against it.
In a Monday decision, the Tenth Circuit reversed the district court’s grant of summary judgment to Johns Manville Corp. based on a monopoly claim from competitor Thermal Pipe Shields. The decision remands the case for further litigation, suggesting it is headed for a trial.
