Becton Dickinson Loses Bid to Dismiss Hernia Mesh Monopoly Suit

Becton Dickinson and Co. failed to convince a federal judge to dismiss claims that the medical device company abused its monopoly in the market for hernia mesh, which is used to repair weakened internal tissue.

Plaintiff TELA Bio Inc. plausibly identified customers in agreements with Becton Dickinson who can’t enter into business with competitors, Judge Gail A. Weilheimer of the US District Court for the Eastern District of Pennsylvania said in an order denying the motion to dismiss.

The ruling, docketed Wednesday, means that TELA Bio’s monopolization claims can proceed to discovery. Becton Dickinson now has 21 days to answer ...
