The Australian Competition and Consumer Commission (ACCC) took a rare step Aug. 16 in filing criminal charges of attempted cartelization against a union and its branch secretary.
Charges for price-fixing cartels usually come when enforcers have discovered an actual agreement among competitors that hurt customers. Enforcement actions about an attempt to form a cartel are unusual anywhere in the world.
The ACCC is bringing the charges against the Construction, Forestry, Maritime, Mining and Energy Union (CFMEU) and Jason O’Mara for criminal cartel conduct in violation of Australia’s Competition Act.
