“The court finds that the consumer plaintiffs have failed to provide a model capable of reliably showing classwide injury and damages in one stroke,” said Judge Yvonne Gonzalez Rogers of the US District Court for the Northern District of California in an order. “Nor can it reliably limit the percentage of uninjured class members, such that the Court may determine whether the class is ‘fatally overbroad.’”
