Amgen, Teva Get New Shot At Appeal of Sensipar Antitrust Ruling

Amgen Inc. and Teva Pharmaceuticals Industries Ltd. received permission for a fast-tracked appeal of a lower court decision as part of an antitrust case involving Amgen’s calcium reducer Sensipar.

The pharmaceutical companies can immediately appeal a decision by Judge Colm F. Connolly finding that he didn’t have the power to allow an interlocutory appeal of a previous judge’s ruling, Connolly said in a Thursday memorandum in US District Court for the District of Delaware.

There is “substantial ground for difference of opinion” about whether a judge can certify for interlocutory appeal another judge’s order in the same case, Connolly said. ...
