Amazon Fails to Fend Off Most State Claims in Price Parity Case

Amazon.com Inc. will face the majority of state claims in an antitrust suit alleging the company caused consumers to pay more for goods due to rules that prohibit third-party sellers from offering products on competing platforms at lower prices.

Judge Vernon S. Broderick of the US District Court for the Southern District of New York in a Thursday opinion allowed claims in 25 states to proceed, concluding that plaintiffs’ allegations as a whole show that Amazon’s goal for its “price parity restriction” was to gain a competitive advantage over competitors.
