OpenAI Inc. and GitHub Inc. were unable to completely shake a copyright lawsuit from a group of open-source software programmers claiming that the artificial intelligence coding tool Copilot unlawfully reproduces their code.
In a mixed ruling, a San Francisco federal judge found on Thursday that the programmers could advance claims that Copilot violated a section of the Digital Millennium Copyright Act that prohibits removing copyright notices and licensing terms from their work.
