The EPA’s use of a specific economic metric when proposing major regulations isn’t traceable to or discriminatory against children alleging climate harms, the Ninth Circuit said Thursday, handing a loss to youth plaintiffs.
The US Court of Appeals for the Ninth Circuit agreed with the lower court that the youth plaintiffs didn’t do enough to establish an injury, show their environmental harms are traceable to the EPA’s actions, or demonstrate the relief they seek would fix the alleged harms.
