Minnesota Appeals Court Keeps State Climate Lawsuit in Play (1)

The American Petroleum Institute, Exxon Mobil Corp., and Koch Industries are still on the hook in a climate misinformation case brought by the state of Minnesota, according to an order handed down by a state appeals court Monday.

The Ramsey County District Court had it right when it rejected the companies’ and trade association’s motion to quash Minnesota’s suit, according to the Minnesota Court of Appeals.

The panel—consolidating multiple separate appeals—dismissed appellants’ personal jurisdiction claims, as well as arguments that the state was placing undue burden on interstate commerce.
