A federal trial court judge set an improperly high standard as she denied an airline engine parts company a preliminary injunction in its trade secrets lawsuit against an ex-employee of 26 years, the Sixth Circuit said.
PCC Airfoils LLC didn’t have to show “clear and convincing evidence” for each of the four preliminary injunction factors, the US Court of Appeals for the Sixth Circuit said. On remand, the lower court must consider whether the factors, taken together on balance, collectively clearly weigh in favor of granting an early injunction against Justin Daugherty during the course of litigation.
