Labor Department Releases 2024 Civil Penalty Update

The US Labor Department is increasing its civil penalty amounts for federal labor law violations effective Jan. 15, under a final rule released Jan. 10.

The maximum civil penalty for repeated or willful minimum wage and overtime violations will rise to $2,451 from $2,374, according to the rule. The maximum civil penalty for unlawfully retaining employees’ tips will rise to $1,373 from $1,330.

Employers subject to the Family and Medical Leave Act that fail to comply with the FMLA’s posting requirements will be subject to a civil penalty of up to $211, up from $204 in 2023.
