Indiana established a tip pool law and made it retroactive to June 28, 2024.
The retroactive effective date of SB 245 is intended to remedy a legal issue that occurred following the US Supreme Court’s decision in Loper Bright Enterprises v. Raimondo, which was handed down June 28, 2024, according to the bill.
SB 245 defines tipped employees as individuals in occupations in which they customarily and regularly receive tips, such as waiters, bellhops, bussers, hostesses, and bartenders.
