A lawsuit filed against the estate of a former employer seeking unpaid wages was allowed to move forward, a federal district court said.
The lawsuit, filed by a married couple, claimed they were not paid overtime wages in violation of the Fair Labor Standards Act and West Virginia labor laws.
The couple’s duties included basic maintenance work around the employer’s home as well as assisting with such tasks as bathing and cooking. The couple also tended to the employer’s medical needs by helping him with physical therapy and taking him to appointments.
