An Aritzia worker sufficiently alleged that the clothing retailer ran afoul of New York law on paycheck frequency for manual workers when it doled out her wages biweekly instead of weekly, a federal judge said.
The worker plausibly suggested that the delayed—but ultimately paid—checks deprived her of the time value of money and that the state law requiring employers to pay manual workers on a weekly basis gives her the right to file a private lawsuit, the US District Court for the Southern District of New York said Thursday.
