Older workers will have a harder time proving age discrimination claims, following a U.S. appeals court decision that tossed out a bank teller’s case because she failed to prove age was the only cause of her termination, attorneys asking the full court to overturn the ruling said.
The Equal Employment Opportunity Commission, the National Employment Lawyers Association, and the AARP Foundation urged the U.S. Court of Appeals for the Sixth Circuit to reconsider a panel decision that they said incorrectly forces older workers to reach a high bar for proving discrimination.
