DOL’s $15 Million Victory in Home-Care Wage Case Survives Appeal

The Labor Department defeated a home-care firm’s challenge to a rule that prevented the firm from claiming some of its employees are exempt from overtime pay, with an appeals court upholding a $15 million judgment for the agency on Wednesday.

Congress gave the DOL authority to change its rule to no longer exempt third-party employers from minimum wage and overtime pay rules, the US Court of Appeals for the Sixth Circuit said, even though the agency had allowed employers to use exemptions known as the “Companionship Services Exemption” or the “Live-In Exemption” for years.
