IRS Disputes Crypto Founder’s Claim of Improper Summons Delivery

An embattled Texas businessman and crypto founder seeking to quash IRS summonses is relying on “at most, minor technical errors” to argue he wasn’t properly served, the agency told the Fifth Circuit.

The IRS argued Monday that the US Court of Appeals for the Fifth Circuit lacks jurisdiction because there’s no legal proceeding against Rowland Marcus Andrade and his company, ABTC Corp. The agency also satisfied its obligatoins when it issued the summonses to what it believed to be the company’s Houston office, the IRS said.

Andrade argued he never directly received them.
