Cruise industry groups have urged a federal court to allow the US to intervene in a lawsuit challenging Hawaii’s environmental tax on cruise ships, arguing the Department of Justice has met the requirements for intervention under Federal Rule of Civil Procedure 24.
The groups, led by Cruise Lines International Association Inc., contend that the federal government’s motion is timely and that it has a significant, protectable interest in upholding federal law. They argued in Hawaii federal court filings that this interest is inadequately represented by existing parties and shares common legal or factual ground with the suit.
