Trustee Picks Up Bankrupt Roadwork Firm’s $4 Million ERC claim

The trustee of a bankrupt construction firm is picking up its former case against the IRS for a delayed Employee Retention Credit refund.

Arvind Mahendru, as Chapter 7 Trustee of the estate of the Florida company DAB Constructors Inc. filed suit seeking $3.96 million in ERC refunds allegedly owed to it. In the US District Court for the Middle District of Florida, Mahendru said he is continuing to navigate that firm’s bankruptcy proceedings, but the IRS has still not responded to the claims that company submitted to the IRS.
