NY Properly Taxed Banker’s Pandemic Telework, Tribunal Affirms

A Bank of Montreal director failed to convince the New York Tax Appeals Tribunal that the state shouldn’t have taxed his 2020 income earned while he worked from Pennsylvania as his Manhattan office was closed due to Covid-19.

Richard Myers “was not obligated by the employer to work from any particular location in or out of state as a requirement of performing his job functions, and nothing in the record reflects that petitioner’s job duties were otherwise affected,” the tribunal said in an opinion released Thursday.
