Supreme Court Justice Sonia Sotomayor requested that Purdue Pharma LP respond to the US government’s bid to block the opioid manufacturer’s Chapter 11 bankruptcy plan from taking effect.
Sotomayor issued the request Friday after Solicitor General Elizabeth Prelogar filed papers with the court earlier in the day. Prelogar argued that Purdue’s bankruptcy plan, which would shield the company’s Sackler family owners from future exposure to opioid victim lawsuits “constitutes an abuse of the bankruptcy system, and raises serious constitutional questions.”
