The Fifth Circuit ordered an antitrust lawsuit against Alphabet Inc.'s Google to be transferred to a California court, finding that a trial judge improperly ordered the case to remain in Texas.
Judge James Ho made the finding in a Tuesday opinion, joined by Judge Catharina Haynes, a George W. Bush appointee. Ho wrote that US District Judge Rodney Gilstrap in the Eastern District of Texas incorrectly leaned too heavily on how long cases take to go to trial in the Northern District of California in denying Google’s motion to transfer the case there.
