The Biden administration has made key changes to the US asylum system following years of increasing migration at the US-Mexico border and ahead of the 2024 presidential election, where immigration and border security have become defining issues.

US law generally allows migrants arriving at the border — including those who would otherwise be subject to expedited removal processes — to claim asylum and remain in the US while their claim is adjudicated. However, the large number of migrants seeking asylum at the border has led the administration to tighten eligibility.
